Terms of Use

The agreement between you and TeslaWatch. Please read the safety and liability sections — they matter more than most.

This is the Terms of Use (EULA) Apple requires to be linked from any app offering an auto-renewing subscription — in the app, on the purchase screen, and in the App Store listing.

1. What TeslaWatch is

TeslaWatch is an independent application that lets you view and control your Tesla vehicle from an Apple Watch and iPhone. It works through Tesla's official Fleet API using access you grant.

It is not made, endorsed, sponsored or supported by Tesla, Inc. See Legal.

2. Eligibility and your account

You must be the age of majority where you live, and you must own or be an authorised driver of every vehicle you connect. You are responsible for keeping your Tesla account and your devices secure, and for anything done by anyone you allow to use them. Connecting a vehicle you are not authorised to control is a breach of these terms and may be unlawful.

You remain solely responsible for the safe and lawful operation of your vehicle at all times.

TeslaWatch offers a free tier and an optional paid Pro subscription.

Refunds

All purchases are processed by Apple, and refunds are handled by Apple, not by us. Request one at reportaproblem.apple.com. We have no ability to issue, approve or deny a refund. Statutory rights — including EU/UK withdrawal rights — are unaffected.

5. Acceptable use

You agree not to: access a vehicle you are not authorised to use; attempt to disrupt, overload, reverse-engineer or circumvent the service or its security; resell or sublicense access; use the app to break any law; or use it in a way that risks anyone's safety.

6. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use TeslaWatch on Apple devices you own or control, per the App Store Terms of Service. We retain all rights not expressly granted. You may not copy, modify, distribute, sell or lease any part of it.

7. Third-party services

TeslaWatch depends on Tesla's Fleet API and Apple's services. They are outside our control and may change, degrade, restrict access or cease. We are not responsible for their availability, accuracy or acts, and changes there may require us to change or remove features.

8. Availability and changes

We may modify, suspend or discontinue features. Where a change materially reduces functionality you have paid for, we will give reasonable notice in the app, and you may cancel through Apple.

9. Disclaimer of warranties

To the fullest extent permitted by law, TeslaWatch is provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that it will be uninterrupted, timely, secure or error-free, that data shown is accurate or current, or that a command will reach or be executed by your vehicle.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, use, goodwill, or damage to property or vehicles, arising from or relating to TeslaWatch — whether in contract, tort (including negligence) or otherwise, and even if advised of the possibility.

Our total aggregate liability for all claims is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) US$50.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you, and you may have rights that these terms cannot affect.

11. Indemnity

You agree to indemnify and hold us harmless from claims, damages and reasonable legal costs arising from your breach of these terms, your misuse of the app, or your operation of a vehicle.

12. Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. The courts of Texas have jurisdiction, except that if you are a consumer, you may bring proceedings in the courts of your country of residence and benefit from any mandatory consumer-protection rules there.

14. Termination

You may stop at any time by deleting your account in the app and removing it from your devices. We may suspend or terminate access if these terms are breached in a way that risks safety or the service. Sections 9 through 12 survive termination.

15. General

If any provision is unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver. You may not assign these terms; we may assign them in a merger or sale of assets. These terms and the Privacy Policy are the entire agreement between us.

16. Changes to these terms

If these terms change materially, the app will say so before the change takes effect, and the date at the top will change. Continued use afterwards constitutes acceptance.
